1. Agreement to Terms

Jony Captions is operated by Yonathan Helperin (יונתן הלפרין), a licensed business in Israel. By using Jony Captions ("Service", "we", "us"), you agree to these Terms of Service.

2. Description of Service

Jony Captions provides automated video captioning services via WhatsApp and a web-based editor. Users send videos through WhatsApp, our AI transcribes the audio, and returns the video with burned-in captions.

Task-Specific Service: Jony Captions is a concrete business task-specific service, not a general-purpose chatbot. It is designed exclusively for video captioning and complies with Meta's 2026 WhatsApp Business Platform policy. For details, see WhatsApp Business Solution Terms.

3. Eligibility

You must be at least 13 years old to use this Service. By using the Service, you represent that you meet this requirement.

3.5 Data Processing Agreement (GDPR)

For users in the EU/EEA:

  • •A Data Processing Agreement (DPA) is available upon request for users subject to GDPR

  • •By using the Service, you acknowledge the data flows described in our Privacy Policy

4. User Accounts

  • •You access the Service via your WhatsApp phone number
  • •You are responsible for all activity under your number
  • •You must not share access or impersonate others

5. Acceptable Use & Content Responsibility

Prohibited Activities:

You agree NOT to:

  • •Upload content that violates any law or third-party rights
  • •Upload content containing child exploitation, violence, or hate speech
  • •Use the Service for spam, fraud, or commercial mass-messaging
  • •Attempt to reverse-engineer, hack, or disrupt the Service
  • •Upload copyrighted content you don't own or have rights to

Your Warranty & Content Responsibility:

By uploading content, you warrant and represent that:

  • •You own or have the legal right to use the video content
  • •The video does not infringe on any third-party intellectual property, privacy, or publicity rights
  • •The video does not contain illegal, defamatory, or harmful content
  • •You have obtained consent from any identifiable individuals in the video
  • •You are solely responsible for any claims arising from your content

6. Content Ownership

  • •You retain ownership of all videos you upload
  • •You grant us a temporary license to process your video (transcribe, add captions, store temporarily)
  • •We do not claim ownership of your content
  • •Processed videos are automatically deleted from our servers after 24 hours

7. AI Transcription & Third-Party Processing

Transcription Disclaimer:

  • •Transcription is AI-generated and may contain errors
  • •We do not guarantee 100% accuracy
  • •You are responsible for reviewing and editing captions before publishing

Third-Party AI Processing:

You acknowledge and consent that:

  • •Your audio is sent to third-party AI providers (Groq, OpenAI) for transcription
  • •Audio is not stored by these providers after transcription is complete
  • •You have read and accept their privacy policies

8. Free Tier, Quotas & Service Changes

Free Tier & Quotas:

  • •Free tier: 5 videos per month
  • •We reserve the right to change quotas, features, or pricing at any time
  • •Premium features may be introduced in the future

Data Deletion Timeline:

Your personal data will be deleted when:

  • •You request deletion by sending "delete my data" to our WhatsApp number, or
  • •Your account remains inactive for 12 months

Deletion will be completed within 30 days of the deletion trigger. You will receive confirmation via WhatsApp when deletion is complete.

Service Discontinuation:

We may discontinue or materially change the Service at any time. If we discontinue the Service, we will provide 30 days' written notice via WhatsApp and/or email. Upon discontinuation, all user data will be deleted per our data deletion policy.

9. WhatsApp Integration

  • •This Service operates via the WhatsApp Business API
  • •By messaging our number, you consent to receiving automated responses
  • •You can opt out at any time by sending "stop" or blocking the number
  • •We comply with WhatsApp's Business Policy and Commerce Policy

10. Intellectual Property

  • •"Jony Captions" name, logo, and caption styles are our intellectual property
  • •You may not use our branding without written permission

11. Limitation of Liability

To the maximum extent permitted by law:

  • •The Service is provided "AS IS" without warranties
  • •We are not liable for any damages arising from use of the Service
  • •Our total liability shall not exceed the amount you paid us (if any)
  • •We are not responsible for WhatsApp outages, API changes, or third-party service failures

12. Indemnification

You agree to indemnify and hold harmless the Company from any claims arising from your use of the Service or violation of these Terms.

13. Termination

  • •We may suspend or terminate your access at any time for violation of these Terms
  • •You may stop using the Service at any time
  • •Upon termination, your data will be deleted within 30 days

14. Changes to Terms

We may update these Terms at any time. Continued use after changes constitutes acceptance. We will notify users of material changes via WhatsApp or the website.

15. Governing Law

These Terms are governed by the laws of the State of Israel. Any disputes shall be resolved in the courts of Tel Aviv, Israel.
